I am pleased to confirm that my application on behalf of local residents for a declaration that because of at least 20 years’ continuous use, the field between Wyatts Lane and Pallance Road containing the public footpath be deemed a Village Green, is to be heard on Monday 7th September (amended from 27th August) in the Council Chamber at County Hall, commencing at 10am.
This use does not in anyway change how the field is to be used in the future. It merely safeguards the way the field has been and is being used by local residents for all those years and indeed even going back before WWII.
This hearing is open to the public and I would be most pleased to see local residents attend to show support for the application.

This hearing was adjourned today to enable the Council to appoint an independent legal expert to advise the Committee on the complex legal and evidential issues which are in dispute.
I am very grateful to those residents who took the trouble to attend, they certainly outnumbered the Objectors by a large margin.
What will happen now is that when the Inspector is appointed, he or she will issue directions on the filing of new or clarifying evidence and related matters so that there is the fullest possible evidence to be considered on which he or she can make clear and reasoned recommendations to the Committee.
The Landowner/Objector has employed Solicitors and a London Barrister so we will need to be on top of our game to prove our case.

All of this will mean more delay but we must get this right. I am hopeful that the adjourned hearing will be this year but if it goes into early 2010, then so be it.
